Bylaw #7 Update

Process dictates that a change to club bylaws requires posting in the club and club website to make members aware of the change. This change refers to Bylaw #7.

The post AGM March 2021 current Bylaw No. 7:

7. All liquor consumed on Club premises must be purchased over the bar. This applies in all situations including wine taken with meals. To protect the club agreement with the catering franchise all food consumed on the club premises shall be purchased from the franchisee. This rule shall apply to members and anyone hiring the club.

Updated Bylaw 7 as agreed at the 11/11/21 Committee meeting:

7. All liquor consumed on Club premises must be purchased over the bar. This applies in all situations including wine taken with meals. To protect the club agreement with the catering franchise all food consumed on the club premises shall be purchased from the franchisee. This rule shall apply to anyone hiring the club. Members will be allowed to consume their own modest packed meals, on an individual basis, for personal consumption after water activities.

 

Rationale for proposed change

This was originally intended to protect the Food Franchisee from people bringing food into the club to eat. Since it was introduced the club has significantly changed.

  • The rule is redundant, not policed, enforced or enforceable
  • It disenfranchises the membership from using their club and eating their own personal packed meal.
  • It is now superseded by the current franchise agreement which does not give the food franchisee monopoly on all food consumed in the club.
  • There are times when the franchisee is not serving meals when the club is open particularly for some sailing and training events during the week and at some weekends.

We need to protect the franchisee but not at the risk of club members using their club facilities and the ability to consume personal packed meals, particularly when food is not being served or where members have particular dietary needs which are not catered for.

The proposed rewording protects the franchisee and the club members and facilitated members to eat packed meal on an individual basis.
